This Agreement (“Agreement”) is entered into by and between: the company  (Forget-Me-Not Books) and business users of the associated website. 

1. Program Overview:  The Company agrees to allow the for the promoting of its remembrance book products through personalized referral links, printed materials, or verbal recommendations. The Affiliate will earn a commission on qualifying sales.

2. Commission & Payment

• Commission Rate: [20-33]% of the pre-tax product price

• Payment Schedule: Monthly, via [PayPal / check / direct deposit]

• Minimum Payout Threshold: $50

• No commission on canceled/refunded orders

 

3. Funeral Industry Responsibilities

The Affiliate agrees to:

• Promote the product in a professional and ethical manner

• Not engage in misleading, false, or spammy practices

• Clearly disclose that this is a service separate from you business when promoting

• Maintain current contact and payment info

4. Authorized Pricing Policy

Affiliate agrees to present and offer Forget Me Not Books at the pricing established and published by Forget Me Not Books.

Affiliate may not:

• Increase, inflate, or modify retail pricing

• Add administrative, handling, or “processing” fees

• Bundle the product into service packages at a higher effective price

• Represent a different price than what is listed on the official Forget Me Not Books website

• Affiliate agrees that any pricing manipulation is grounds for immediate termination without notice

 

5. Company Responsibilities

The Company agrees to:

• Provide member accounts and invoices to monitor  orders, billing and pay outs.

• Fulfill all referred customer orders and handle customer service

• Provide space on books for the ordering business’ contact information

 

6. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, no new commissions will be earned, but unpaid commissions from valid past referrals will still be paid.

 

7. Intellectual Property

Affiliate may use Forget Me Not Books' name, logo, and marketing materials for promotional purposes only. All intellectual property remains the sole property of the Company.

 

8. Limitation of Liability

The Company is not liable for indirect or incidental damages related to this program. Total liability will not exceed the total commissions paid to the Affiliate.

 

9. Independent Contractor Status

Affiliate is an independent contractor. Nothing in this agreement shall be construed as a partnership, joint venture, or employment relationship.

 

10. Entire Agreement

This Agreement constitutes the full understanding between both parties and supersedes all prior discussions.
